If intoxication is the \u201cproximate cause\u201d of the injury, all benefits are forfeited. If intoxication above legal limit, rebuttable presumption that intoxication was proximate cause. The request shall be directed to the employer or its insurer by certified mail.\u00a0<strong>287.215<\/strong><\/p><p><strong>BURDENS OF PROOF<\/strong>:<strong>287.808<\/strong><\/p><p><strong>Affirmative defense<\/strong>\u00a0\u2013 Burden on employer<\/p><p><strong>Entitlement to compensation<\/strong>\u00a0\u2013 Burden on employee<\/p><p><strong>Facts<\/strong>\u00a0\u2013 must be established as \u201cmore likely true than not true\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55c45fa elementor-widget elementor-widget-heading\" data-id=\"55c45fa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">PERMANENT PARTIAL DISABILITY: <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48f0cb3 elementor-widget elementor-widget-text-editor\" data-id=\"48f0cb3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cDisability shall be demonstrated &amp; certified by a physician.\u201d All opinions expressed to a \u201creasonable degree of medical certainty.\u201d Objective findings [\u201cthose findings demonstrable on physical examination or by appropriate tests or diagnostic procedures\u201d] shall prevail over subjective complaints.Compensation reduced to extent pre-existent disability contributed to overall rating.\u00a0<strong>287.190.6<\/strong>\u00a0<strong>et seq<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4e6dc4 elementor-widget elementor-widget-heading\" data-id=\"d4e6dc4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">DEATH:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-546ecfa elementor-widget elementor-widget-text-editor\" data-id=\"546ecfa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Dependent defined to mean only spouse &amp; children age 18 or under unless a student or disabled from wage earning. Partial dependents no longer covered. (2017 amendment)\u00a0<strong>287.240<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e019185 elementor-widget elementor-widget-heading\" data-id=\"e019185\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">AMPUTATION:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51fb7b8 elementor-widget elementor-widget-text-editor\" data-id=\"51fb7b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The number of weeks of compensation allowed in the schedule shall be increased by ten percent (10%).\u00a0<strong>287.190.2<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2f1c257 elementor-widget elementor-widget-heading\" employee to the hazard prior to evidence of disability is liable.\u00a0<strong>287.063.2<\/strong><\/p><p>Statute of limitations shall not begin to run until it is reasonably discoverable injury sustained \u201crelated to such exposure.\u201d\u00a0<strong>287.063.3<\/strong><\/p><p>Injury from occupational disease is compensable only if \u201coccupational exposure was the prevailing factor\u201d in causing the condition.\u00a0<strong>287.067.2<\/strong><\/p><p>Injury from repetitive motion is compensable only if \u201coccupational exposure was the prevailing factor\u201d in causing the condition.\u00a0<strong>287.067.3<\/strong><\/p><p>Employee who contracts communicable disease from employment shall be eligible for benefits as an occupational disease.\u00a0<strong>287.067.7<\/strong><\/p><p><strong>Aging<\/strong>\u00a0\u2013 \u201cOrdinary gradual deterioration \u2026 of the body caused by aging \u2026 shall not be compensable.\u201d\u00a0<strong>287.067.2<\/strong><\/p><p><strong>Three Month Rule<\/strong>\u00a0\u2013 liability only allowed to relate back to the \u201cimmediate prior employer.\u201d\u00a0<strong>287.067.8<\/strong><\/p><p><strong>NOTICE<\/strong>: Claim barred unless written notice within 30 days unless employer not data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Failure to use safety devices \u201dshall\u201d reduce benefits by \u201cat least 25% but not more than 50%.\u201d Employer must only demonstrate \u201creasonable effort\u201d to ensure employee use of devices and employee\u2019s failure to use no longer need be \u201cwillful.\u201d\u00a0<strong>287.120.5<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a955484 elementor-widget elementor-widget-heading\" data-id=\"a955484\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">COMPUTING AVERAGE WEEKLY WAGE \/ COMPENSATION RATE:287.250<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a068d23 elementor-widget elementor-widget-text-editor\" data-id=\"a068d23\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The method of computing an injured employee\u2019s average weekly earnings shall be as follows:<\/p><p><strong>1.<\/strong>If the wages are<strong>\u00a0fixed by the week<\/strong>, the amount so fixed shall be the average weekly wage;<\/p><p><strong>2<\/strong>.If the wages are\u00a0<strong>fixed by the month<\/strong>, the average weekly wage shall be the monthly wage so fixed multiplied by twelve and divided by fifty two;<\/p><p><strong>3.<\/strong>If the wages are\u00a0<strong>fixed by the year<\/strong>, the average weekly wage shall be the yearly wage fixed divided by fifty two;<\/p><p><strong>4<\/strong>.If the wages were\u00a0<strong>fixed by the day, hour, or by the output<\/strong>\u00a0of the employee, the average weekly wage shall be computed by taking the wages earned in the last thirteen consecutive calendar weeks immediately preceding the week in which the employee was injured and dividing by thirteen. If the employee was employed by the employer for less than thirteen weeks, then take the wages earned in the period of time actually worked and divide by the actual number of weeks worked. For purposes of computing the average weekly wage in this paragraph, the absence of five regular or scheduled work days, even if not in the same calendar week, shall be considered as absence for a calendar week. If the employee began employment on a day other than the beginning of a calendar week, that calendar week and the wages earned during that week shall be excluded in computing the average weekly wage;<\/p><p><strong>5<\/strong>.If the employee has been employed\u00a0<strong>less than two calendar weeks<\/strong>\u00a0immediately preceding the injury, the employee\u2019s weekly wage shall be considered to be equivalent to the average weekly wage prevailing in the same or similar employment at the time of the injury, except if the employer has agreed to a certain hourly wage, then the hourly wage agreed upon multiplied by the number of weekly hours scheduled shall be the employee\u2019s average weekly wage; and<\/p><p><strong>6<\/strong>.If the hourly wage has not been fixed or cannot be ascertained, or the employee earned no wage, the wage for the purpose of calculating compensation shall be taken to be\u00a0<strong>the usual wage for similar services<\/strong>\u00a0where such services are rendered by paid employees of the employer or any other employer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d334f67 elementor-widget elementor-widget-heading\" data-id=\"d334f67\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">STATUTE OF LIMITATIONS:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c541c9 elementor-widget elementor-widget-text-editor\" data-id=\"3c541c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>No proceedings can be maintained unless a claim is filed with the Division within two years after the date of injury or death, or the last payment made under the Act on account of the injury or death;
